These Terms of Use govern all purchases from the Holy Infa merchandise store. By placing an order, you agree to these terms in full.

This store operates from Germany and complies with German consumer protection laws, including the 14-day cancellation right (FADG).

1. General Terms & Conditions

These terms and conditions ("Terms") govern your use of the Holy Infa merchandise store ("Store") and your purchases of merchandise products.

By accessing or purchasing from the Store, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Store or purchase any merchandise.

We reserve the right to modify these Terms at any time. Your continued use of the Store following the posting of revised Terms means you accept and agree to the modifications.

2. Offer and Order Process

2.1 Product listings on our Store constitute an invitation to make an offer, not an offer to sell. The presentation of merchandise and prices are subject to availability and errors.

2.2 When you place an order, you submit an offer to purchase merchandise on the terms specified in these Terms. Your offer is submitted when you click the "Order with payment obligation" button. We will send you an order confirmation email with all order details.

2.3 Our acceptance of your order is confirmed in the order confirmation email. A contract is formed when we send this confirmation. We reserve the right to refuse any order.

2.4 All product descriptions, images, and specifications are provided in good faith. We strive for accuracy but do not warrant that descriptions or images are error-free or complete.

3. Payment Process

3.1 MANUAL INVOICE-BASED PAYMENT: Our Store operates on a manual invoice payment system:

• After placing an order, you will receive an order confirmation email

• Within 24-48 hours, you will receive an invoice (Rechnung) with payment instructions

• Payment must be made within 14 days from the invoice date

• Accepted payment methods include bank transfer (SEPA), PayPal, and credit card (details provided in invoice)

• Your order will be processed and shipped after payment is received and verified

3.2 PAYMENT DEADLINE: Failure to pay within the specified timeframe may result in order cancellation and inventory reallocation.

3.3 PAYMENT INFORMATION: All payment information will be transmitted via secure encrypted channels. We use industry-standard SSL/TLS encryption.

3.4 PRICES: All prices are quoted in EUR including applicable VAT. Shipping costs are calculated and shown separately before checkout. Prices are subject to change without notice, but changes will not affect orders already placed.

4. Shipping and Delivery

4.1 FULFILLMENT: Our merchandise is fulfilled through a third-party print-on-demand service (Printful). This allows us to offer high-quality, customized merchandise.

4.2 SHIPPING CARRIERS: Shipments are dispatched via international courier partners (DHL, UPS, FedEx, or equivalent) depending on destination.

4.3 DELIVERY TIMES: Standard shipping typically takes 7-14 business days from order dispatch (after payment is received). Rush orders may be available at additional cost.

4.4 INTERNATIONAL SHIPPING: We ship to most countries. International orders may be subject to additional customs duties, taxes, or import fees that are the responsibility of the recipient.

4.5 RISK OF LOSS: Risk of loss passes to you upon delivery to the carrier. We are not responsible for loss or damage in transit. We recommend selecting tracked shipping options.

4.6 TRACKING: A tracking number will be provided via email once your order ships.

4.7 DELIVERY ADDRESS: You are responsible for providing accurate delivery information. We are not liable for orders shipped to incorrect addresses provided by you.

5. Product Specifications and Quality

5.1 PRODUCT QUALITY: All merchandise is produced to industry standards. Print quality, color accuracy, and material composition are verified by our production partner.

5.2 COLOR VARIATIONS: Colors may vary slightly from website images due to monitor display settings, printing process variations, or material properties. We cannot guarantee exact color matching.

5.3 SIZE GUIDANCE: Size charts are provided for each product. We recommend reviewing these carefully. Size availability and accuracy are the responsibility of the manufacturer.

5.4 CUSTOMIZATION: Custom designs or modifications may be available. Custom orders require acceptance of proofs and are typically non-refundable.

5.5 PRODUCT AVAILABILITY: While we strive to keep inventory updated, out-of-stock situations can occur. In such cases, we will contact you immediately to discuss alternatives or refund options.

6. Returns, Exchanges, and Cancellation Rights

6.1 CANCELLATION RIGHT (14-DAY FADG WITHDRAWAL RIGHT): In accordance with German consumer law (FADG - Fernabsatzgesetz), you have the right to cancel your order within 14 days without providing a reason.

6.2 CANCELLATION PERIOD: The cancellation period begins on the day you receive the merchandise and ends 14 days later.

6.3 HOW TO CANCEL: To exercise your cancellation right, send written notice to: merch@holyinfa.com with your order number and reason for cancellation (optional). Cancellation must be received before the 14-day period expires.

6.4 RETURN PROCESS:

• You must return merchandise within 14 days of cancellation notice in original condition with all packaging

• Contact contact@holyinfa.com for return shipping instructions

• Return shipping costs are your responsibility unless the return is due to our error

• Include your order number on the return shipment

6.5 REFUND: Upon receipt and inspection of returned merchandise in original condition, your full purchase price will be refunded within 14 days.

6.6 EXCEPTIONS: Cancellation right does not apply if:

• Merchandise has been worn, washed, or visibly used

• Packaging or tags have been removed

• Merchandise was damaged due to mishandling

• You have returned merchandise previously and abuse the policy

6.7 EXCHANGES: Defective merchandise or incorrect orders can be exchanged. Contact contact@holyinfa.com with photos and order details.

6.8 REFUSED DELIVERIES: If you refuse a delivery without valid reason, return shipping costs and a 15% restocking fee will apply.

7. Defects and Warranty

7.1 PRODUCT DEFECTS: We warrant that merchandise is free from manufacturing defects at the time of delivery. Defects include stitching failures, print defects, color bleeding, or material defects not related to normal use.

7.2 DEFECT CLAIMS: You must report defects within 30 days of receiving merchandise. Photographs and detailed description of the defect are required.

7.3 WARRANTY COVERAGE: We will, at our option, repair, replace, or refund defective merchandise covered by this warranty.

7.4 WARRANTY EXCLUSIONS: This warranty does not cover:

• Normal wear and tear

• Damage caused by improper care, cleaning, or storage

• Damage from external causes (stains, tears, etc.)

• Color fading from normal washing or sun exposure

7.5 TEXTILE CARE: Follow care instructions included with merchandise to preserve quality.

8. Limitation of Liability

8.1 CONSEQUENTIAL DAMAGES: To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, or lost data.

8.2 LIABILITY CAP: Our total liability to you is limited to the amount you paid for the merchandise in question. This applies to all claims, whether based on warranty, contract, tort, or any other legal theory.

8.3 APPLICABLE LAW: Some jurisdictions do not permit limitation of liability, so this limitation may not apply to you. In such cases, our liability is limited to the maximum extent permitted by applicable law.

8.4 THIRD-PARTY SERVICES: We use third-party services (Printful, shipping carriers, payment processors) but remain responsible for their performance under these Terms. Any disputes regarding third-party services should first be directed to us.

9. Intellectual Property Rights

9.1 STORE CONTENT: All text, graphics, logos, designs, images, and other materials on the Store are the property of Holy Infa or our licensors and are protected by copyright and trademark laws.

9.2 USER LICENSE: You are granted a limited, non-exclusive license to view the Store for personal, non-commercial purposes. No other use is permitted without prior written consent.

9.3 RESTRICTIONS: You may not:

• Reproduce, distribute, or transmit content from the Store

• Modify, adapt, or create derivative works

• Remove or obscure copyright or trademark notices

• Use content for commercial purposes

9.4 CUSTOMER DESIGNS: If you provide custom designs or content for merchandise, you warrant that you own or have permission to use such content. You grant us a worldwide license to reproduce your design on merchandise ordered by you.

9.5 THIRD-PARTY CONTENT: Some merchandise may feature third-party brands, characters, or designs. Your purchase grants a license to use such merchandise for personal use only, not for commercial resale or modification.

10. User Conduct and Prohibited Actions

10.1 You agree not to use the Store to:

• Upload or transmit viruses or malware

• Harass, threaten, or abuse others

• Violate applicable laws or regulations

• Infringe on intellectual property rights

• Engage in fraud or deception

• Circumvent security or authentication measures

• Resell merchandise obtained from our Store as a business without authorization

10.2 We reserve the right to suspend or terminate access to the Store for violation of these provisions.
